Obama’s October 2016 tweet about “the need for a ninth justice” being used against him

Republicans are pointing to former President Obama’s October 19th 2016 tweet about “the need for a ninth justice” and using it against him.

At the time, in wake of Justice Scalia’s death, Obama wrote “The need for a ninth justice is undeniably clear. #DoYourJob”

Obama then added a meme with his own quote “Already this past June, we saw a deadlocked Supreme Court, with no tie-breaking vote, unable to reach a majority on a major immigration case – leaving our nation’s immigrants in Limbo.”

Conservatives are now reminding Obama of the tweet.

Another Twitter user wrote “Never did I ever think I would be in agreement with Barry, but here we are. The need for a ninth justice is undeniably clear. Do your job.”

Obama himself, has now changed his tune.

In a statement Obama attributes his change in thinking over the argument that Republicans set a new precedent and the need for “everyday fairness” and “consistency.”

Obama writes “Four and a half years ago, when Republicans refused to hold a hearing or an up-or-down vote on Merrick Garland, they invented the principle that the Senate shouldn’t fill an open seat on the Supreme Court before a new president was sworn in.”

Obama continues “A basic principle of the law — and of everyday fairness — is that we apply rules with consistency, and not based on what’s convenient or advantageous in the moment.”
